Stop Expropriation Without Compensation!
The Fatherland Foundation intends to have certain provisions of the new Expropriation Act declared unconstitutional. There are many provisions in the Act that are not controversial, and to a certain extent constitute an improvement on the 1975 Act.
The principle, however, that any form of property can be expropriated without compensation at market value, goes against all principles of any constitutional state, as well as international law.
For that reason, we are of the opinion that the provisions relating to possible payment for a property to be expropriated, at a lower amount than market value, are unconstitutional, and that they are also directly contrary to article 25 of the Constitution of the Republic of South Africa.
The Fatherland Foundation therefore intends to have parts of this Act declared unconstitutional, and will launch such a court application without the cooperation of any other parties.
The Vaderland Foundation is assisted by legal practitioners on a special basis, but still needs funds to manage and drive such an application.
